Question 1:
If you were a Framer of the Constitution, would you agree with the
separation of powers into the three branches of the government? Why or
why not? Are there any additional powers or authority that you think are
necessary to assign to a particular branch? Why or why not?
Question 2:
Upset at seeing Russia invade Ukraine and the United States’ refusal to send
Ukraine fighter planes and troops, Ursula files a lawsuit against President
Biden. Ursula is a citizen of the United States, has never been to Ukraine,
and has no family or property there. Does she have standing to bring the
lawsuit? Why or why not?
Question 3:
Hamad is an Uber driver in Boulder, Colorado. While stopped at a red light,
he is hit from behind by a FedEx truck driven by Federico. FedEx refuses to
pay for the damages because Federico’s route is in Denver, he was not
supposed to be in Boulder, and he was on his lunch break. Hamad files a
lawsuit against FedEx in Denver District Court. Does this court have proper
venue over the accident? Why or why not?
Extra Credit:
“As good government is an empire of laws, how shall your laws be made? In
a large society, inhabiting an extensive country, it is impossible that the
whole should assemble to make laws. The first necessary step, then, is to
depute power from the many to a few of the most wise and good.” ~John
Adams, Thoughts on Government, 1776
John Adams (vice president under George Washington then elected the 2nd
president of the U.S.) argues that it is impossible for direct democracy to
work in a large nation. Instead, he envisioned a representative democracy in
which “a few of the most wise and good” create laws for the benefit of the
people. Do you think his vision has been realized in the US? Why or why
not?
